What is a Spouse Visa?

The Spouse Visa, also known as a Partner Visa, is your gateway to living and working in the UK if you are married to a British Citizen or someone with indefinite leave to remain. You can apply for this visa if you are:

  • The husband, wife, or civil partner.
  • An unmarried partner (living together for at least 2 years).
  • A fiancé or fiancée, planning to marry in the UK.

Eligibility Criteria for Spouse Visa

To qualify for a Spouse Visa, you must meet specific criteria:

To qualify for a Child Dependency Visa, one of the following conditions must be met:

  • Prove a Genuine Relationship: Show evidence of a real, committed partnership through documents like photographs and joint financial commitments.
  • Meet Financial Requirements: Demonstrate the ability to financially support your spouse or partner, exceeding the government’s threshold.
  • Show Financial Self-Sufficiency: Prove you can financially support yourself in the UK without relying on public funds.
  • Provide Suitable Accommodation: Offer evidence of adequate housing in the UK, such as tenancy agreements or letters from your host.
  • Demonstrate English Language Proficiency: Depending on your circumstances, show your English language proficiency to ensure effective communication and integration.

Spouse Visa Extension

After receiving an initial 2-year and nine-month visa, you can extend your Spouse Visa for an additional 2 years and six months (30 months). Maintain your genuine relationship and meet the exact requirements for this extension, ensuring you apply before the current visa expires.

Indefinite Leave to Remain (ILR) after Spouse Visa

After residing in the UK for 5 years as a spouse/partner, you can apply for ILR. This grants you permanent residency in the UK, freeing you from visa regulations.

To qualify for ILR, you must meet the following criteria:

  • Lived continuously for 5 years under the spouse/partner route.
  • Lived together with your spouse/partner.
  • Maintain a genuine and subsisting relationship.
  • Intend to continue the relationship.
  • Satisfy the English language and Life in the UK test requirements.
  • Provide suitable accommodation.
  • Meet financial requirements.

Fiancé/Fiancée Visa

The Fiancé/Fiancée Visa allows foreign nationals over 18 to come to the UK for marriage or civil partnership with a British citizen or a UK-settled person (with settled status or indefinite leave to remain). Once married or in a civil partnership, you can switch to a Spouse Visa.

To qualify for a Fiancé/Fiancée Visa:

  • Demonstrate a genuine relationship.
  • Meet financial requirements.
  • Show knowledge of the English language.
  • Provide suitable accommodation.

Unmarried Partner Visa

The Unmarried Partner Visa permits unmarried individuals with a British citizen or UK-settled partner to reside in the UK for up to 33 months. To qualify, you must prove a genuine relationship lasting at least 2 years and meet all eligibility criteria.
